Officers at the senior and middle management level of CBDT who are responsible for the delivery of tax dispute resolution services for direct taxes or will be in a role in this area in future.
Qualifications
No formal qualifications are necessary, but participants should have at least five years' experience in CBDT or its' field formations.
Course Description
A key component of any modern tax administration is an effective dispute resolution process to deal with disputes arising between taxpayers and the administration. The desired outcome for a tax dispute resolution process is that it is fair and independent, is accessible to taxpayers and is effective in resolving disputed matters in a timely manner.
This virtual workshop will commence with a foundational discussion on the elements of a dispute resolution process and different methodologies in vogue. It will go on to cover good practice in dispute resolution and developments such as advance binding rulings and alternative dispute resolution techniques. Participants will gain exposure to strategies for decreasing disputes through the provision of certainty, via publication of the administration's views on potentially contentious issues or the use of compliance agreements with taxpayers. Participants will also learn the importance of impartiality, independence and timeliness in resolving disputes, which would reinforce the perception of fairness of their decisions and processes after they return to their organization.
Areas covered during the workshop will include:
- Dispute management techniques
- Good international practices in dispute resolution including examples from tax administrations
- How to minimize disputes
At the completion of the workshop, participants will be equipped with an understanding of the elements of an effective tax dispute resolution process and good international practices in dispute resolution. This can be expected to contribute to the ability of officers of CBDT, India to better conduct dispute resolution activities in the short to mid-term.
Course Objectives
Upon completion of this course, participants should be able to:
- Improve participants' knowledge of good practices in tax dispute resolution, including alternative dispute resolution, to undertake effective dispute resolution work in their organization.
- Provide an opportunity to practice this improved knowledge and reinforce learnings through workshops.
